A German court has imposed a potential EU-wide ban on the Samsung Galaxy Tab 7.7 as part of the Korean firm's bitter row with Apple.

The Duesseldorf Higher Court upheld an earlier ruling and disagreed with the High Court by finding that the device unlawfully copied the design of the iPad.

Samsung said it was “disappointed with the court's ruling” on the Galaxy Tab 7.7, a 7-inch tablet which sells in the UK for £379.

"We will continue to take all available measures, including legal action, to protect our intellectual property rights and defend against Apple's claims to ensure our products remain available to consumers throughout the European Union," a spokesman said.

The German decision came despite the recent, contradictory judgment of the High Court. Judge Colin Birss QC found that none of Samsung's Galaxy Tab range copied the iPad, saying they were "not as cool". He ordered Apple to take out national newspaper adverts admitting as much.

The German preliminary injunction was granted against Samsung's Korean parent company, however, so it would apply to the whole of the EU if enforced.

The German court broadly agreed with the High Court in finding that Samsung's 10-inch tablet did not infringe Apple's designs. Samsung had however tweaked the design of the frame of the Galaxy Tab 10.1 model for the German market and renamed it the Galaxy Tab 10.1N after a court last year said the model violated Apple's patents.

"Samsung welcomes the court’s ruling which confirms our position that the Galaxy Tab 10.1N does not infringe Apple’s intellectual property and does not infringe laws against unfair competition,” a Samsung spokesman said.

Germany has become a major battleground in the global patent war between makers of mobile phones, tablet computer devices and their operating software as court actions there have proved relatively cheap and speedier than in other jurisdictions.

Apple and Samsung have been engaged in a legal battle worldwide since Apple sued Samsung in the United States last year, saying the South Korean company's Galaxy line of mobile phones and tablets "slavishly" copied the iPhone and iPad.

An attempt to mediate the dispute failed, with the two giants disagreeing over how much each other's patents were worth. A court showdown in California, dubbed the "patent trial of the century", is scheduled to begin on Monday.

S Korea bans some Apple and Samsung products

Court in Seoul rules that both technology giants infringed on each other's patents in battle for smartphone supremacy.


Apple and Samsung have been banned from selling some of their products in South Korea, after a court ruled that they both infringed on each other's patents on mobile devices.

The court ruling on Friday comes as the two firms are locked in a bitter patent battle that could determine their fight for supremacy in the global smartphone market.

The Seoul Central District Court ordered Apple to remove the iPhone 3GS, iPhone 4, iPad 1 and iPad 2 from store shelves in South Korea, ruling that the products infringed on two of Samsung's telecommunications patents.

The court also ruled that Suwon, South Korea-based Samsung had infringed on one of Apple's patents related to the screen's bounce-back ability and banned sales of the Galaxy S2 and other products in South Korea.

Samsung filed a lawsuit against Apple in Seoul in April last year regarding infringement of patents related to telecommunications standards.

Apple responded in June by filing a counter suit claiming Samsung copied the design and user interface of its iPhone and iPad.

The split ruling is not expected to make any impact on the broader dispute which involves legal action in several nations including the US and Australia.

The South Korean decision comes ahead of a high-stakes US jury verdict that is expected to signal the future course of the rival firms' tussle for smartphone supremacy.

Bitter battle

n the US court, Apple is seeking more than $2.5bn after accusing the Korean firm of infringing designs and other patents. Samsung says Apple infringed its patents for wireless communication.

It is one of several legal cases around the world involving the two electronics giants in the hottest part of the tech sector - tablet computers and smartphones.

While the results so far have been mixed in courts in Europe and Australia, Samsung has a lot at stake in the US case, which could result in large damages or injunctions against its products in the American market.

A recent survey by research firm IDC showed Samsung extended its lead over Apple in the smartphone market in the second quarter despite slowing demand for mobile phones.

Samsung shipped 50.2 million smartphones globally in the April-June period, while Apple sold 26 million iPhones. IDC said Samsung held 32.6 per cent of the market to 16.9 per cent for Apple.

Samsung has steadfastly denied abusing Apple patents and countered in court that Apple has been taking advantage of some of the South Korean company's patented technology for wireless connections.

The battle is all the more complex as Apple and Samsung are not only competitors in the fast-growing global market for smartphones and tablet computers, but also have a close business relationship.

Samsung, the world's biggest manufacturer of memory chips and liquid crystal displays, supplies some of the key components that go into Apple products.

In the end, they both still needs each other, Apple needs Samsung to manufacture the chips for their iPhones while Samsung needs Apple continued business to give them the boost they already enjoying now

Just looking at the software, I think I'd prefer a Windows Phone. But neither Windows Phone nor Android have the support that iOS has. If you've heard of a cool mobile-game or app, then you can be 99% sure that it's going to be on iOS. Android and Windows Phone simply can't give you that level of certainty.


The same applies to tablets. To a greater degree, in fact. If it's an issue of cost, then I'd recommend the new Google Nexus 7 tablet. If it's an issue of conformity, then I'd say suck it up and go with an iPad. :awesome:

What's more, Android apps seem to give you greater control over the phones or SOMETHING, because I've had friends that, when their apps crashed, they had to hard reboot the entire phone because it froze.

Now I have an iPhone and I love it to pieces. It's so great. There's a bajillion apps for them, and I'm gonna buy TWEWY like in a week or something.

But I have a Macbook and I hate it. I've never been fond of Apple products. So please take it from me--I don't have an iPhone because I like Apple, it's because I think it's a good phone.

And all THAT being said, making iPhone apps is a pain in the butt. Android apps on the other hand are just strange Java and easy as pie. I've been considering buying an Android phone soon--not to use, but to make apps on.

SO MANY OPTIONS.

The only qualm I have with the Nexus 7 is its lack of expandability (no SD card slot). Other than that it is an absolutely fantastic device. Google Now completely smokes Siri.

As for Apple, they can go get Fuzzy Bunny for all I care. Horrible company with horrible practices.
